Splicky is a website located at www.splicky.com (the "Website"), that assists Advertisers and Agencies in the purchase and placement of advertising market space by connecting the User to publishers (the "Services"). Splicky is the new Demand-Side Platform (DSP) available for the mobile channel using proprietary Real-Time Advertising (RTA) technology. Our mobile DSP enables Advertisers to deliver targeted and effective mobile advertising campaigns in real time with complete transparency, and it enables Agencies to manage their clients' targeted and effective mobile advertising campaigns in real time with complete transparency. The Website is owned and operated by Goldbach Digital Services AG, Küsnacht (CH) ("GDS," "Company," "we," "our," or "us").
The terms "you," "your," and "yours" shall refer to anyone accessing, viewing, browsing, visiting or using the Website in any manner, and shall and shall mean You individually (in the event you do not represent a business entity or other juristic person), or the company or entity you represent. The terms "Customer," "User," and "Advertiser" shall refer to anyone - including You - who retains us for the Services we provide and which are described more fully in our Terms and Conditions (or the "Agreement"). The terms "Visitor" and "Consumer" shall include all others - including You - who may not be described as a Customer, User, or Advertiser. The terms defined in this paragraph shall be construed to include, without limitation, any parent entities, owners, subsidiaries, predecessor or successor entities, and any agents, officers, directors, or employees acting on behalf of same. You and We may also be individually referred to herein as a "Party" and collectively as "Parties."
GDS Data Collection Terms and Tools
GDS operates a Service through which Customers bid for placement of their Advertisements on web publishers and exchanges. When GDS honors our Customers' bids, we do collect some information. It is important, however, for you to know what information we collect and what information we do not collect. There are two types of information related to our services: personally identifiable information (PII) and non-personally identifiable information (NPII). PII includes data such as your name, address, phone number, social security number or email address. NPII includes data like the domain type (e.g.: .com, .org, etc.) and standard data which is part of every web communication. It also includes what type of device you use (i.e.: computer, smartphone, etc.), operating system, settings or types of ads you've viewed.
Most websites use "cookies." We do, too. A cookie is a piece of data sent from a website and stored in the web browserÂ of a Customer or Consumer while he or she is browsing a website - in this case, our website. When the Customer or Consumer browses the same website in the future, the data stored in the cookie can be retrieved by the website to notify the website of his or her previous activity. We also use web beacons. A web beacon (i.e.: a "clear gif") is a transparent graphic image that is placed on a website. The web beacon lets us measure the actions of the party opening the page that contains the beacon. Cookies and web beacons are often used together and in a manner described elsewhere in this Policy.
Data Collection Overview
When GDS follows a Customer's bid and places an advertisement with a publisher or on an exchange, we do not collect PII. We do, however, collect NPII, and that helps us learn how Consumers interact with the web: what browser they use, what internet service provider connects them to the web, what ads or content they viewed, and the like. We do this without using or exploiting sensitive personal information (e.g.: medical data). We merge this NPII with analytical data (also NPII) from third-party partners (e.g.; demographics, behavioral studies) so that we can better understand the NPII, and what it says our Customers want and what our Consumers want. It helps us recognize correlations between what you do and what may interest you, and it helps us bring a better quality, better tailored service to you.
GDS Data Collection for our Corporate Site
Subject to certain exceptions below, GDS does not collect or ask visitors to reveal any personal information on our corporate website. GDS uses NPII from our Web site log files to determine how you found out about us, what your interests are regarding our services, and how to further improve our site and our service towards you.
GDS sets our cookies to expire after three (3) years and the expiration date updates every time you encounter our server.
To Opt Out
If you do ultimately decide that you do not want the benefits of cookies, and are comfortable with the Services without the benefit of cookies, you may "opt out" through the option on our website. A User or Customer may also provide us with PII (as explained above), when the User or Customer elects to initiate contact with us. From time to time, we may ask you to provide PII that will enable us to improve the site or our services to you. If you contact us and in doing so, elect to provide us with personal information, we will only utilize such personal information for the purpose of responding to your inquiry or otherwise assisting you in a matter requested by you, and we do reserve the right to retain a record of such correspondence. If you choose not to provide requested PII, some features of the Site or our Services may become unavailable. It is always your choice whether or not to provide the PII.
We pledge to keep your personal data confidential and use it solely to aid in your relationship with us. From time to time, we may want to alert you to product upgrades, special offers, updated information, and other new products and services offered by or through us. Only We (or agents or contractors working on behalf of us and under confidentiality agreements) will send you such information. In such an instance, we may use or merge your information collected at the Site with data from third parties for these promotions. Information Sharing and Disclosure to Third Parties
GDS may publish or otherwise make public anonymous, aggregate or summary information regarding our Site visitors and work run on behalf of our Customers as part of our business and marketing activities. This allows us to advise Customers and future customers on the best way to use our Services and whether to use our Services. We may share visitor level data with a Customer, which data is limited to data associated with the client's use of our Services. We will never share such visitor data with any third parties.
We may have agents and contractors who, like employees, officers, or directors of GDS, perform services on our behalf. These agents and contractors may have access to the personal data of Users or Visitors for the purpose of performing services on behalf of GDS. We require them to sign and execute confidentiality agreements with us, and we hold them to our standards and subject them to this Policy, as well as our underlying policies and procedures that are evidenced by this Policy.
There also may be instances when we may disclose User or Consumer information - including PII and NPII - in order to: protect the legal rights of GDS or its employees, agents and contractors; protect the safety and security of visitors to our Site; protect against fraud; or to comply with the law or judicial process, but only after notice to you, as permitted by law. If GDS sells all or part of its business or makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, asset-purchase, bankruptcy, or other transaction, we may transfer User or Consumer information to a third party as part of that transaction.
Further, third-party websites may be accessed through out site and may collect PII or personal data or information of any kind about you. We are not responsible for and our Policy does not cover the information or privacy practices of such third-party sites. When you leave our site, you should read the privacy statements of any other website you visit and which collects personally identifiable information.Except as set forth herein, GDS does not rent, sell or share personal information or data it collects about Customers or Consumers to or with third parties. Under no circumstance does GDS sell the personal data of Customers or Consumers.
International Transfers of Data
Personal data collected by GDS on its own behalf or on behalf of GDS clients may be stored and processed in the United States or any other country in which GDS or its affiliates, subsidiaries, agents or customers maintain facilities. You acknowledge and agreed that personal data you or your audience provides to us may be transferred outside of the country in which you or they reside. Providing such information will constitute your consent to any such transfer.
GDS follows generally accepted industry standards to protected unauthorized access to, destruction or disclosure of data. Any online payment transactions occurring on this site will be secured using industry standard encryption technology. Data is stored on our servers is treated as confidential. Those servers are protected by firewalls and are located in secure data facilities. However, we cannot guarantee that any method of transmission over the internet shall be secure. As a result, we cannot guarantee the absolute security of your personal security and shall not be liable for any breach of security by an outside party, despite our best efforts and observation of commercially reasonable and customarily accepted best practices.
As part of the Service, you will receive login credentials. You must use all commercially reasonable efforts to prevent unauthorized used of, or access to, the Service, including safeguarding any login credentials applying to Your Account. You alone are responsible for maintaining the confidentiality of any login credentials. You agree not to use the login credentials of another user at any time or to disclose your login credentials to any third party. You agree to notify GDS immediately if you suspect any unauthorized use of your login credentials or access to your account. You are solely responsible for any and all use of your account.
Our website is using Piwik, a web analytics software. Piwik uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. For this purpose we use the Piwik analysis procedures. In this case we store data. The servers are located in Germany. With this procedure, data is anonymized upon collection and evaluated in aggregated form. Your browser automatically transfers data to our server as soon as you access our websites.
